Dispositions diverses en matière d’impôt sur les revenus
Monsieur le Président, cela ne nous est pas coutumier mais pour vous livrer les observations ainsi que les propositions du CESC, je commencerai en vous disant que nous nous réjouissons de ce projet de délibération. En effet, nous vous rappelons, ainsi qu'à l'ensemble des membres de cette Assemblée, que nous avions interpelé les services et les élus de la Collectivité sur la nécessité de transposer les normes nationales fiscales (adossées à une exonération de charges sociales), concernant la PPV et les Pourboires, afin d'éviter tout sentiment de discrimination entre travailleurs saisonniers non-résidents et travailleurs résidents saint-martinois.

Le CESC a bien noté que l'actualisation du zonage d'assainissement des eaux usées, ainsi que la mise en place et le lancement d'une enquête publique représentent une étape fondamentale pour la Collectivité de Saint-Martin.
Perception des impôts, fixation de taux, barèmes et montants
Au regard de l'ensemble des éléments chiffrés, des tableaux comparatifs fournis par les services de la Collectivité, au regard des explications et éclairages qui nous ont été apportés par la Direction de la fiscalité de la Collectivité et compte tenu de leurs analyses, les membres du CESC prennent bonne note du caractère inchangé du taux de la taxe foncière qui n'a pas augmenté depuis 2011.
Anticipation des effets du changement climatique à Saint-Martin
Saint-Martin, faisant partie intégrante de ce chapelet d’îles, il nous semble opportun de prendre connaissance de ces risques pour préserver notre territoire et protéger sa population. Dans les conditions actuelles de ce dérèglement climatique, dans l’attente des conclusions de la COP 28 qui ne dérogeront pas aux précédentes, et pour prendre toute notre part dans cette course contre la montre, une véritable prise de conscience collective s’impose et des actions d’adaptation nécessaires devront être prises et, de toutes évidences, elles bouleverseront très sensiblement nos modes de vie et de consommation. C’est en tout cas l’objectif recherché de ce rapport à l’attention de nos décideurs mais aussi de tous les publics.

Les membres du Conseil Economique et Social ont pris connaissance du rapport succinct émis concernant la nécessité de créer une mission de préfíguration en vue de l'émergence du comité territorial des pêches maritimes et des élevages marins. Ils souhaitent rappeler que des travaux avaient été entrepris, dans le milieu socio économique pour structurer cette filière, et comme rappelé par le rapport, les marins pêcheurs s'étaient regroupés en février 2021.
Projet de délibération portant adoption de la stratégie en faveur de l’économie bleue durable
Les membres du Conseil Economique et Social ont entendu la présentation faite du rapport de BRL ingénierie en collaboration avec les techniciens de la Délégation Attractivité, Economie et Emploi de la Collectivité. Ils ont bien pris note qu'un travail conséquent a été établi en amont de cette stratégie mais relèvent que le document est très général et regrettent son caractère très théorique. Ils regrettent notamment que les structures existantes, et particulièrement la filière nautisme du lvcée Daniella JEFFRY, qui est en place depuis plusieurs années, ne soit pas suffisamment valorisée.

Demande d’habilitation en matière de Revenu de solidarité active
L’Assemblée plénière du Conseil économique social et culturel a pris connaissance d’un rapport accompagnant le projet de délibération d’une excellente qualité tant sur la forme que sur le fond. C’est donc à l’appui d’informations précises présentant les origines du dispositif, le cadre juridique dans son ensemble, l’expérience saint-martinoise de tentatives d’adaptation, et même les véhicules législatifs potentiels que les membres du CESC ont pu se prononcer. L’approche comparée du niveau de prestations au niveau national et à Saint-Martin est particulièrement instructive.

La société civile représentée a pris acte de la volonté de la Collectivité de mettre à jour la convention en date du 10 mars 2008 passée avec la Direction générale des finances publiques (DGFIP), représentée à Saint-Martin par le Centre des Finances Publiques (CFP). L’assemblée plénière du CESC, le 13 juillet 2023, a conclu globalement que toutes les initiatives tendant à renforcer les liens et les modalités de collaboration entre les services de la Collectivité et le CFP étaient tout à fait louables.
Vote du budget supplémentaire 2023
Les résultats dégagés en 2022 permettent d’augmenter le budget de fonctionnement de 36,85 millions d’euros dont près de 21 millions qui seront fléchés pour de nouvelles dépenses réelles. La répartition précise et transparente présentée dans le rapport n’empêche pas le lecteur de constater les montants historiques enregistrés sur les chapitres 11 et 65 qui dépassent ou égalent les budgets dégagés post-Irma.

Développement, promotion et animation de l’écosystème Economie Sociale et Solidaire favorable pour la création, la structuration, le développement et le renforcement des entreprises, et de l’ensemble des structures de l’ESS du territoire de Saint-Martin
Les membres de la société civile représentée ont reçu le projet de la Collectivité tendant au développement, à la promotion et à l'animation de l'écosystème Economie Sociale et Solidaire à Saint-Martin. Ils en comprennent le sens et émettent toutefois quelques réserves.
Adoption du compte administratif 2022 de la Collectivité de Saint-Martin
Les membres du Conseil économique social et culturel de Saint-Martin ont étudié avec intérêt ce compte administratif porté par la nouvelle mandature qui traduit la réalité de l'exécution budgétaire pour sa première année de gestion. Le CESC apporte en introduction deux réserves de méthodes. Alors qu'il se satisfaisait, dans son avis du 27 mars dernier, des échanges avec l'Administration et de la consultation préalable à l'envoi officiel des documents préparatoires pour le Conseil territorial, il semble que ce temps soit révolu puisque qu'aucune réunion de travail officielle avec l'Administration n'a été programmée depuis et que la notification du Président, datée du 5 juin, n'a été réceptionnée par la Présidente du CESC, par mail du 9 juin 2023.
